EV Cargo Privacy Policy

EV Cargo Limited are the controller of the information (personal data) that we collect. This policy explains how, and we use your personal data, how long we keep it for and your legal rights. This policy applies to all EV Cargo subsidiaries within the group.

How your data is stored

Your personal data is held in both hard copy and electronic formats.
Electronic data, including emails, is stored on EV Cargo’s servers and on our software suppliers’ servers, which are located in the UK.

Where we contract with a software supplier who stores data outside of the EU, only minimal data is processed, and we ensure appropriate safeguards are in place where necessary.

How long is the data stored?

This will depend on the information collected, there are different timeframes for certain data. We are bound by legal and best practice retention periods. When the information is no longer required, we destroy this securely.

This information is processed for our legitimate interests of responding to any enquiries you make through our website, apps and customer software and to help us understand and improve of our website.

Contact details for people, organisations, and companies we work with is personal data and we treat it accordingly.  We will use it only as part of our relationship with your organisation, whether we work in partnership or have a customer/supplier relationship.

This processing is based on our legitimate interests of managing business relationships and member relations. We use the data only for the purpose listed, we will not use the data for another reason, and this is kept secure

You’ll be asked to confirm that you’re happy to provide your personal data and that you give permission to EV Cargo to process your personal data. All the details such as why Boots want your data, how it will be used and if your data will be shared, will be provided at the time of asking you for your consent. Where EV Cargo are relying on consent you will usually see a tick box. You have the right to withdraw your consent at any time if you no longer want to be part of the EV Cargo processing activity

Direct Marketing

We will send you information that we think will be useful or of interest to you about the services we provide, whether they are paid for services or free of charge.

If you choose to register, your information will no longer be anonymous and will be available to EV Cargo staff and to delegations for the purpose of marketing. If you do not wish to continue receiving promotional or marketing information, please notify us by email at [email protected].

 

We send you emails or texts (electronic direct marketing) with this type of information if we have your consent to do so. For commercial services or products, which includes where you have bought, or entered negotiations with us, for a similar service or product, this is regarded by the law as implied consent. However, every time we send an email or text you will have the option to unsubscribe from similar marketing messages.

 ‘Processors’

When we use other companies to deliver our products or services on our behalf, sometimes we need to share relevant information with those suppliers and subcontractors so they can carry out work on our behalf. They are known as our ‘Processors’ and are legally bound by contract to act only on our instructions regarding your personal data, and not use it for their own purposes.

The relevant legal basis for each Processor we use will be dependent on the type of work they do, and our legal basis for undertaking the work. We have contracts with Processors that comply with Article 28 of the General Data Protection Regulation (GDPR).
CCTV

EV Cargo use CCTV in our offices, warehouses and sites for the safety and security of premises, products, colleagues, contractors, customers, the public and any third parties. Some systems are operated by specialist security companies, who we have contracts with.

CCTV footage may be disclosed to those organisations acting on official authority, including the police, as necessary to investigate potential crimes and to prosecute crimes.

We process data from CCTV in our legitimate interest to protect property, warehousing and for carrying out tasks under our legal obligations and in the public interest/substantial public interest; these include protecting the safety of people and premises and supporting investigations into and prosecutions of crime and fraud, and other misconduct.
Recruitment

If you apply for a job, we collect information about your suitability to the role.

We collect information about race/ethnic origin, religion, health/disability, or sexual orientation and gender.

The personal data collected is on the basis that it is necessary for an employment contract or to enter a contract of employment with you.

 

Where it is necessary for us to monitor and improve equality of opportunity and treatment, in the substantial public interest, and it is optional for you to provide this information. We do not use the information collected for equal opportunities for assessing application suitability. There is a separate policy for recruitment that tells you how and why your data is used.

Employees

We collect and process information about current and former employees.

Most of this processing is on the basis that it is necessary for managing your employment contract. We also must fulfil our legal obligations under employment law in relation to current and former employees. There is an employee privacy policy that tells you how and why your data is used.

 

 

Equality of treatment & opportunity

We are treating everyone fairly and providing equal opportunities, regardless of differences in race or ethnic origins, religious or philosophical beliefs, physical or mental health or sexual orientation, this is where it is necessary for us to monitor and improve equality of opportunity, in the substantial public interest. When we collect equal opportunities information it is not used to assessing your suitability for recruitment or employment.

 

 

The processing of these special categories of data is necessary for a task which is in the substantial public interest, specifically for the purposes of identifying and monitoring equality of opportunity and treatment between different groups of people, with a view to enabling equality to be promoted or maintained. It is optional for you to provide this information.

Rights

  • Your right to object to processing – You have the the right to object to the processing of your personal information in certain circumstances.
  • Your right to data portability – You have the right to ask that we transfer the personal information you gave us to another organisation, or to you, in certain circumstances.
  • Your right not to be subjected to a fully automated decision-making process (i.e., a system generated decision without any human input), where the outcome has a legal or similarly significant effect on you.
  • You have the right to withdraw your consent at any time by contacting us.

You are not required to pay any charge for exercising your rights. If you make a request, we have one month to respond to you, we have the right to refuse a request in some circumstances and the law allows us to extend the timeframe up to two months. There may be occasions where an administrative charge is applied.

SECURITY

We intend to protect the quality and integrity of our personal information. EV Cargo has implemented technologies and security policies to protect the stored personal data of our users from unauthorised access, improper use, alteration, unlawful or accidental destruction and accidental loss. EV Cargo employees and processors who have access to personal data are obliged to respect the privacy of our visitors and the confidentiality of their personal data.
